1. Scope and Application
1.1 These Terms and Conditions apply to all in-person workshops, art courses, Creative Pause Art Retreats, parent & child sessions, online programmes, events, mentoring sessions and digital products provided by Harriet Norwood Poole trading as little art berlin (“little art”), including services delivered at third-party partner venues within Berlin.
1.2 For corporate events and private group workshops, additional or separate terms apply as outlined in Sections 16 and 17.
1.3 In the event of any conflict between these Terms and the terms of a third-party venue, the venue’s terms take precedence for matters relating to the use of their premises and property care.
2. Bookings and Payments
2.1 Bookings must be made through littleartberlin.com or by invoice and are confirmed only upon receipt of payment or a specified deposit.
2.2 A booking is valid for one named participant unless otherwise stated. Babies under six months (non-participating, worn in a carrier) may attend parent & child classes free of charge, subject to space.
2.3 Unpaid reservations cannot be held.
2.4 For private group or corporate events booked by invoice, a non-refundable deposit of 50 % of the total fee is required to secure the booking.
2.5 For Creative Pause Art Retreats and art courses, payment confirms acceptance of these Terms and is non-refundable once made.
3. Cancellations and Refunds
3.1 In-person classes and courses (block bookings):
(a) Cancellations 21 days or more before start date: refund minus €50 fee.
(b) Less than 14 days before start date: non-refundable.
(c) Transfer of entire booking to another named participant permitted within first 14 days of block starting.
3.2 Online programmes (block bookings): same policy as above unless otherwise specified in course materials.
3.3 Trials, demo and pop-up workshops: Non-refundable and non-transferable to another date. Name changes may be made in advance by email. Only one trial per person per class series is permitted.
3.4 Single workshops and Creative Pause Art Retreats: Non-refundable and non-transferable to another date. Name transfers permitted up to 7 days before by email.
3.5 Art mentoring / coaching: Non-refundable once booked. Sessions may be rescheduled with at least 48 hours’ notice; otherwise the fee is retained.
3.6 Cancellations by little art: If little art must cancel a class, workshop or retreat, a refund or credit will be issued within 30 days unless cancellation is due to force majeure. For adult art programmes, if an in-person session cannot run, it may be delivered online where appropriate.
4. Attendance
4.1 Children’s block bookings are valid only for scheduled weeks of the term (excluding holidays). Specific day and time slots are fixed; missed classes cannot be made up.
4.2 Adult programmes, courses and retreats are valid only for the booked date(s); make-up sessions are not provided.
5. Prices and Payment Terms
5.1 All prices are exclusive of statutory VAT (19 %) which will be added at checkout or invoice.
5.2 Full payment must be received at the time of booking; no cash payments accepted.
5.3 Overdue payments incur interest at 5 % per annum above the base rate (§ 247 BGB).
5.4 Payments from outside the EU require prior email confirmation.
6. Liability
6.1 little art is liable for intent and gross negligence in accordance with statutory law.
6.2 For slight negligence, liability is limited to foreseeable, typical damages arising from breach of essential obligations.
6.3 Liability for injury to life, body or health remains unaffected.
6.4 This limitation extends to freelancers and assistants engaged by little art.
6.5 little art accepts no liability for loss or damage to personal belongings brought to events or venues.
7. Health and Safety
7.1 Participants should wear clothing suitable for messy activities. little art is not liable for stains or damage to clothing, shoes or personal items.
7.2 In parent & child workshops, parents or carers are fully responsible for their children’s supervision and safety.
7.3 In drop-off classes, parents must disclose any allergies or sensitivities before attendance.
7.4 Participants must follow all venue guidance and health instructions.
7.5 For online activities, health and safety remain the participant’s responsibility.
8. Insurance
8.1 Parents or carers should hold valid personal liability insurance (Haftpflichtversicherung), including coverage for children (“deliktunfähige Kinder”). Proof may be requested.
8.2 little art maintains appropriate professional and public liability insurance for all events and retreats.
9. Accessibility and Additional Needs
9.1 Clients must inform little art in advance of any additional needs or access requirements.
9.2 A pre-visit or planning conversation may be required to ensure accessibility and safety.
10. Collection and Drop-Off
10.1 Unknown persons collecting a child must show photo ID.
10.2 Only individuals named on the registration form may collect children.
11. Intellectual Property and Recording
11.1 All materials, videos, worksheets and content provided by Harriet Norwood Poole trading as little art berlin remain her intellectual property.
11.2 Clients receive a personal, non-transferable licence for individual use only.
11.3 Content may not be copied, shared or distributed without written permission.
11.4 Audio or video recording of sessions is prohibited unless authorised in writing.
11.5 Sessions may be photographed or recorded by little art for marketing or archival purposes. By attending, clients consent to the use of their image unless they opt out in writing before the session.
12. Digital Products and Online Hub
12.1 Digital products (downloads, videos, templates) are non-refundable once accessed.
12.2 Use is personal and non-transferable; commercial or educational reuse requires written permission.
12.3 No guarantee of specific results is made; creative impact depends on individual engagement.
13. Photography and Media
13.1 Photographs and videos taken during classes or retreats may be used by little art for marketing and documentation unless clients opt out in writing.
13.2 Once published online, third-party reuse cannot always be prevented.
14. Venue Use and Property Care
14.1 Participants agree to treat all venue furnishings, equipment and materials with care.
14.2 Any damage, staining or loss caused by misuse of materials or disregard of instructions will be charged to the responsible participant or client.
14.3 Participants must follow all house rules, noise levels and hygiene requirements communicated by the venue or organiser.
14.4 The organiser reserves the right to remove any participant whose behaviour disrupts safety or comfort.
14.5 Any additional cleaning or repair fees charged by the venue to little art will be passed on in full to the responsible party.
15. Force Majeure (including Public Health Regulations)
15.1 Events outside either party’s reasonable control release both parties from in-person delivery obligations while the situation continues.
15.2 If an event cannot take place due to public health rules or other force majeure, little art may retain any deposit and reschedule within one year of the original date.
15.3 Where possible, little art may offer online delivery instead of in-person; no refund is due for format changes.
15.4 If the client chooses to proceed despite regulations, they accept any extra compliance costs in full.
15.5 If rescheduling within one year is impossible, either party may cancel in writing. Non-refundable deposits are retained.
15.6 If force majeure continues beyond one year, either party may terminate the contract by written notice.
16. Private Group Workshops (Third-Party Venues)
16.1 A non-refundable deposit of 50 % of the total invoice is required to secure the booking.
16.2 Cancellations: up to 14 working days before = 75 % due; up to 7 days before = 100 % due.
Venue Booking Responsibility
(a) Where little art arranges and books the venue on behalf of the client:
• Client acknowledges the fee includes venue hire.
• Venue cancellation fees or extra charges (e.g. overuse, damage, regulations) are passed on to the client.
• Client must follow all venue rules and policies (noise, materials, hygiene).
(b) Where the client books their own venue:
• Client is responsible for suitability, insurance and compliance.
• Client covers any damages or costs arising from their venue arrangements.
• little art accepts no liability for loss or cancellation arising from external venue issues.
17. Corporate Events
17.1 Corporate events are governed by separate Corporate Terms & Conditions provided at quotation stage.
17.2 Corporate clients must accept those terms before confirmation.
18. Governing Law
18.1 These Terms are governed by the laws of the Federal Republic of Germany.
18.2 Jurisdiction is Berlin.
18.3 These Terms supersede all prior agreements.
18.4 Where minors are involved, both parents must consent unless legally exempt; one signature implies representation of the other.
